Terms of Service
These Terms of Service ("Terms") govern your use of MemoryDock, provided by FriendlyMiles Digital Ventures LLC ("FriendlyMiles Digital Ventures," "we," "us," or "our"). By creating an account or using the service, you agree to these Terms and our Privacy Policy.
Eligibility and accounts
You must be at least 18 years old and legally able to agree to these Terms. Provide accurate information, protect your sign-in credentials and devices, and notify security@memorydockapp.com if you suspect unauthorized access. You are responsible for activity under your account.
The service and paid plans
MemoryDock helps you capture, organize, retrieve, archive, export, and delete personal memories. Features may change over time. A paid plan may be required to create, edit, use voice capture, or access certain features. Plans presented in the iOS app may include auto-renewable subscriptions and/or a lifetime non-consumable purchase through Apple In-App Purchase.
Apple processes payment and billing. Cancellation of Apple subscriptions and refund requests are handled under Apple’s terms and Apple Media Services terms. Manage subscriptions in Apple ID settings or App Store subscriptions. Access and entitlement status may be evaluated using Apple transaction data and RevenueCat as infrastructure. Product details and prices shown before purchase control the transaction; MemoryDock does not promise a free trial unless one is expressly presented with that purchase.
Purchases made through the App Store are also subject to Apple’s Licensed Application End User License Agreement (EULA): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
Your content
You retain ownership of content you submit. You give FriendlyMiles Digital Ventures LLC a limited, worldwide license to host, process, reproduce, and transmit that content only as needed to operate, secure, support, and improve the service and comply with law. You represent that you have the rights and permissions needed for content you provide, including information about other people.
Acceptable use
You may not use MemoryDock to violate law or another person’s rights; upload malware or harmful material; probe, disrupt, overload, or bypass service security; access another person’s account or data without permission; reverse engineer the service where prohibited; or use automated means in a way that harms the service. Do not store complete passwords, full card numbers, CVVs, Social Security numbers, bank credentials, or recovery codes.
Voice, classifications, locks, and important decisions
On supported iPhones, voice transcription uses Apple’s speech-recognition framework. Speech recognition and automatic organization may be unavailable, delayed, or inaccurate. Review transcripts, categories, and saved content. MemoryDock does not intentionally save or upload raw microphone audio to its servers or cloud transcription providers, but availability and processing depend on permissions, device capabilities, and Apple’s speech features.
Lock Memory is interface access control using Apple device-owner authentication, not end-to-end encryption. The web does not unlock or reveal locked-memory contents in v1, and locked content continues to use the existing Supabase backend and storage architecture.
MemoryDock is a convenience tool, not medical, legal, financial, emergency, or other professional advice, and it is not represented as HIPAA-compliant. Do not rely on it as the only record for deadlines, safety-critical information, or important decisions.
Third-party services
The service relies on providers such as Supabase for authentication and storage; Apple for its speech-recognition framework, device authentication, and iOS In-App Purchase; RevenueCat for purchase-entitlement infrastructure; Resend or another configured provider for transactional authentication email; and PostHog for limited analytics not intended to include memory contents or voice transcripts. By default, MemoryDock does not send microphone audio to cloud speech-to-text vendors. If you enable optional cloud transcription fallback in Settings, temporary audio may be processed via MemoryDock’s secure servers and Groq Whisper as described in the Privacy Policy; otherwise Apple’s speech-recognition framework remains the primary path. Grok/xAI is not used for transcription. Third-party services may have their own terms and privacy practices. We are not responsible for third-party products outside our control.
Export, deletion, and termination
You may stop using the service at any time. Export content to a device destination you choose, then use Settings → Delete Account. The confirmation dialog offers Cancel or Delete Account; opening it, choosing Cancel, pressing Escape, or dismissing the backdrop does not delete. Confirming deletion permanently removes your account, active and archived memories, account audit records, settings, and profile. Deletion cannot be undone. We may suspend or terminate access for material violations, security risks, legal requirements, or discontinued operation, using reasonable notice when practical. Provisions that by their nature should survive termination will survive.
Service availability and disclaimers
To the fullest extent permitted by law, MemoryDock is provided "as is" and "as available." FriendlyMiles Digital Ventures LLC disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee uninterrupted, error-free, or loss-free operation. Some jurisdictions do not allow certain disclaimers, so they may not apply to you.
Limitation of liability
To the fullest extent permitted by law, FriendlyMiles Digital Ventures LLC and its affiliates, officers, employees, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, profits, goodwill, or opportunities arising from the service. FriendlyMiles Digital Ventures LLC’s aggregate liability for claims relating to the service will not exceed US $100 or the amount you paid FriendlyMiles Digital Ventures LLC for the service in the preceding 12 months, whichever is greater. Applicable law may provide non-waivable rights.
Changes
We may modify the service or these Terms. We will post updated Terms and provide additional notice when legally required. Continuing to use the service after revised Terms take effect means you accept them; if you do not agree, stop using the service and delete your account.
Governing terms
These Terms and incorporated policies are the entire agreement about the service. If one provision is unenforceable, the remainder stays effective. Failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization or business transaction.
Rights and dispute resolution
The law of the State of North Carolina, United States, applies to any dispute, including the express jurisdiction of the local courts where FriendlyMiles Digital Ventures LLC is established, as well as applicable consumer protections.
